Bayer’s Push For State-Level Roundup Immunity Sparks Backlash In The Heartland

Bayer’s Push For State-Level Roundup Immunity Sparks Backlash In The Heartland

In a brazen bid to shield itself from a tsunami of lawsuits over its toxic Roundup herbicide, Monsanto (acquired by Bayer Pharmaceutical) has unleashed a multi-state lobbying blitz to secure immunity from liability, with Missouri as a key battleground.

The agrochemical giant, reeling from over $8.68 billion in pre-reduction jury verdicts and $11 billion in settlements, is pushing state legislatures to pass bills that would block “failure-to-warn” claims tied to glyphosate, Roundup’s cancer-linked ingredient.

But their heavy-handed tactics have sparked fierce resistance, exposing the corporate underbelly of a company desperate to dodge accountability.

In Missouri, home to Bayer’s North American Crop Science headquarters, the company ramped up its lobbyists from four to nine – or about 1.29 lobbyists for each of the seven Senators of the Missouri Senate Agriculture Committee – directly before introducing Senate Bill 14, and its companion House Bill 2763.

Both bills – nearly identical to those seen in each state where courts have awarded billions for harms – were aimed at shielding Monsanto-Bayer from lawsuits claiming Roundup causes non-Hodgkin’s lymphoma.

Missouri trial lawyer Matt Clement has successfully represented clients in their claims that Roundup was the cause of non-Hodgkin’s lymphoma.

“Monsanto is trying to push legislation that would take away constitutional rights,” Clement told ZeroHedge. “It [Bayer] has not been successful in getting courts to buy its preemption argument, so it is resorting to trying to pass state legislation that will do what most courts have refused to do.”

Missouri courts have already hammered Bayer with massive verdicts: $611 million, upheld on appeals in 2025 for three plaintiffs in Cole County (originally $1.56 billion), and $1.25 million for John Durnell in St. Louis.

With 40,000 cases still pending in Missouri alone, Bayer’s panic seemed palpable. Their strategy? Convince lawmakers that EPA-approved labels, which omit cancer warnings – despite jurys awarding plaintiffs a whopping total of $19.68 billion in verdicts and settlements to-date – should preempt state litigation.

“State law claims, which Monsanto is trying to take away with the proposed legislation, are the only way for private citizens to hold companies accountable,” Clement explains.

In 1947, Congress created The Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). Last significantly amended in 1972, FIFRA – administered by the Environmental Protection Agency (EPA) – requires pesticides to be registered with the EPA before they can be sold or distributed in the United States.

The law aims to ensure that pesticides are safe for human health and the environment when used according to their labeling.

However, when FIFRA was last reviewed by the EPA, the alleged harms of Roundup (backed by $19.68 billion in settlements) were not yet known. In addition, courts have held that private citizens can’t use FIFRA to sue pesticide manufacturers for damages if they are injured by a chemical.

“In other words,” Clement tells ZeroHedge, “only the EPA can enforce the terms of that law. Because the EPA only reviews the chemicals every fifteen years, there is no real enforcement mechanism except state law. If the proposed legislation takes that away, there is nothing left for an injured person to do.”

Due to the fact that registration and warning labels are administrative law, the only way to hold a company like Monsanto-Bayer accountable for not properly warning consumers, is through state-based constitutional law. Rather than pay out billions in on-going settlements, Bayer shifted its focus to PR and lobbying state lawmakers.

Bayer’s campaign, funneled through the Modern Ag Alliance and “murky groups” like the Protecting America Initiative, has spent an estimated $150,000 to $700,000 across 12 states, including Missouri, Iowa, and Georgia.

In Missouri, nine Freedom Caucus Senators were targeted—Nick Schroer, Brad Hudson, Rick Brattin, Ben Brown, David Gregory, Mike Moon, Joe Nicola, Adam Schnelting, and Jill Carter—with vicious direct-mail flyers.

The mail flyers accused the Freedom Caucus members of betraying American farmers and aiding China by opposing the bill. The senators, incensed by what they called “dark money” attacks, vowed to investigate via the Missouri Ethics Commission, effectively killing HB 2763 in the Senate through a filibuster.

The missteps were catastrophic.

Bayer underestimated bipartisan fury, with 24 House Republicans and 48 Democrats rejecting the bill.

Aggressive ads and sponsorship of Governor Mike Kehoe’s inauguration reeked of corporate overreach, alienating allies and fueling perceptions of prioritizing profits over public health. Critics also pointed to Monsanto’s history of manipulating science, as exposed in California courts, which found the company focused on PR over safety.

Nationwide, Bayer’s playbook proved more successful as Georgia passed an immunity bill (SB 144) into law this year. The new law could impact a $2.1 billion jury verdict awarded to plaintiff John Barnes, as Bayer is expected to appeal the case.

North Dakota and Montana also passed shields, but legislative efforts faced resistance in states like Iowa, Florida, Tennessee and Idaho. With 54,000–67,000 lawsuits still looming and a $16 billion litigation war chest, Bayer’s now scrambling for help from the U.S. Supreme Court and lobbying hard for Farm Bill amendments that reinforce federal preemption.

However, Congress could just as easily amend FIFRA to explicitly preserve states’ rights or strengthen EPA labeling oversight. Meanwhile, the Trump administration can also update EPA regulations or issue executive guidance to limit the scope of federal preemption.

These steps would close the loophole Bayer is attempting to exploit at the state level, ensuring victims of Roundup’s alleged harms, can seek justice without federal interference.

Either way, the fight highlights the need for regulatory reforms as the outcome will shape pesticide regulation for years to come.

Bayer’s attempt to rewrite the rules and escape accountability has only hardened resolve among farmers, health advocates, and legislators alike. But, just as this saga illustrates the “corporate capture” outlined in the MAHA Report, the fight over Roundup’s label is far from over.

Détente? Musk Hints At Path Forward On BBB, Will Not Decommission Dragon Spacecraft

Détente? Musk Hints At Path Forward On BBB, Will Not Decommission Dragon Spacecraft

Update (2204ET):  The optics of what happened this week between Elon Musk and President Donald Trump are wild – with Musk standing up for MAGA ideals that Trump campaigned on, and Trump peddling a bill that came from the swamp. Musk’s key issues are that it raises the debt ceiling another $5 trillion, while – and this part is in contention – the bill either raises the deficit by $2.4 trillion, or lowers it by $1.4 trillion – depending on who you believe. We note that it also makes little to no effort to actually do anything about the waste, fraud, or abuse found by DOGE.

So, following a rollercoaster of a day (scroll down if you just emerged from a coma), on top of a rollercoaster week, Musk struck a different tone Thursday night on X after a long 12 hours which saw Trump threaten to pull federal funding from Musk’s companies for opposing the BBB, which was met Musk calling his bluff and declaring he would decommission the SpaceX Dragon (the only operational US spacecraft capable of transporting astronauts to and from the International Space Station), proposing a new political party “that actually represents the 80% in the middle,” implying Trump is a pedophile, and endorsing Trump’s impeachment.

Now that the dust has settled, Musk appears to have struck somewhat of a conciliatory tone Thursday night – first posting that he would not in fact decommission Dragon.

He also reposted several things on X hinting at a path forward if Republicans fix the bill.

Musk also reposted Senator Rand Paul suggesting that he would vote for the BBB “if we got real spending cuts” instead of “the largest debt increase in US history.”

He also replied “You’re not wrong” to Bill Ackman’s suggestion that Trump and Musk “should make peace for the benefit of our great country.”

And then he made fun of himself.

In short, Trump and Republicans need to “Drop the tax cuts, cut some pork, and get the bill through” so it aligns with MAGA and DOGE priorities (what you were elected to do), kith and make up, and make sure JD doesn’t have to spend Christmas at two houses this year.

Update (1725ET): As the Trump-Musk feud continues to escalate, Musk endorsed the notion that ‘Trump should be impeached and JD Vance should replace him,’ floated by Malaysian US political commentator Ian Miles Cheong.

Earlier…

Aaaand Musk just announced he’ll begin decommissioning the SpaceX Dragon spacecraft ‘immediately’

He also doubled down on the Epstein claim…

While Trump defenders such as Laura Loomer pushed back:

Trump, meanwhile, posted what could be considered somewhat of an attempt to de-escalate – that he ‘doesn’t mind Elon turning against me, but he should have done so months ago,” adding “This is one of the Greatest Bills ever presented to Congress. It’s a Record Cut in Expenses, $1.6 Trillion Dollars, and the Biggest Tax Cut ever given.”

Update (1615ET): Just as the spat between Elon Musk and President Trump seemed to have reached cruising altitude, Musk hit the afterburners – claiming on X that President Trump is “in the Epstein files,” adding “That is the real reason they have not been made public…

Meanwhile, shares in TSLA are down 16% as the market cascades lower. Fun fact, Tesla was the most bought retail stock over the last week.

Update (1255ET): The tech-bro industrial complex has to be shitting themselves as the Trump-Musk spat just hit a new gear; Elon Musk is calling for a new political party, while Trump just threatened to pull Musk’s contracts.

Kevin Dietsch/Saul Loeb/AFP/GETTY

In a Thursday afternoon post to Truth Social, Trump said that Elon was “wearing thin,” and that he “Asked him to leave.”

“I took away his EV Mandate that forced everyone to buy Electric Cars that nobody else wanted (that he knew for months I was going to do!), and he just went CRAZY!“

Trump then ‘truthed’ that “The easiest way to save money in our Budget, Billions and Billions of Dollars, is to terminate Elon’s Governmental Subsidies and Contracts. I was always surprised that Biden didn’t do it!”

“Such an obvious lie. So sad.” Musk replied…

Before calling Trump’s bluff…

And is calling for a new political party…

Which has an 84% ‘yes’ rating…

Update (1255ET): Well that escalated quickly…

Elon Musk is now raging on X against President Trump, after Trump talked greasy to the press over Musk’s opposition to the “Big Beautiful Bill” over the past several days.

“Without me, Trump would have lost the election, Dems would control the House and the Republicans would be 51-49 in the Senate,” Musk wrote, adding “Such ingratitude.”

Meanwhile Tesla stock is down 9%…

And Palantir is down 5% as the tech bro darlings come under pressure…

*  *  *

President Trump has weighed in after Elon Musk began publicly bashing the GOP’s ‘Big Beautiful Bill,’ telling reporters on Thursday that he’s ‘very disappointed in Elon,’ and that Musk only opposes the bill because they eliminated electric vehicle tax credits from it.

“Elon is upset because we took the EV mandate which was a lot of money for electric vehicles. They’re having a hard time the electric vehicles, and they want us to pay billions of dollars in subsidy. Elon knew this from the beginning,” said Trump.

Trump also suggested that Musk “recommended somebody he knew very well to run NASA. I didn’t think it was appropriate, and he happened to be a Democrat, like totally Democrat.”

Musk, meanwhile responded with “Whatever” to Trump…

“Keep the EV/solar incentive cuts in the bill, even though no oil & gas subsidies are touched (very unfair!!), but ditch the MOUNTAIN of DISGUSTING PORK in the bill,” Musk wrote. “In the entire history of civilization, there has never been legislation that both big and beautiful. Everyone knows this!”

“Either you get a big and ugly bill or a slim and beautiful bill. Slim and beautiful is the way.”

And then there’s this…

He then addressed Trump’s specific comments regarding the bill, posting “False, this bill was never shown to me even once and was passed in the dead of night so fast that almost no one in Congress could even read it!”

Prior to Trump’s comments, Musk spent much of the morning re-posting old Trump tweets calling for no ficits and to stop raising the debt ceiling.

Over the past several days Musk has dug in over the issue – posting to X on Tuesday, “I’m sorry, but I just can’t stand it anymore. This massive, outrageous, pork-filled Congressional spending bill is a disgusting abomination.”

This sent the White House scrambling to do damage control – with Budget Director Russ Vought sending Congress a request for a $9.4 billion clawback for unspent foreign aid funding – which if you’re Musk, after what DOGE has uncovered, is a huge slap in the face.

On Wednesday, Musk continued to rage on X – posting: “Call your Senator, Call your Congressman, Bankrupting America is NOT ok! Kill the Bill.” – followed by a ‘Kill Bill’ movie poster featuring Uma Thurman.

Musk’s solution? A new spending bill that doesn’t jack the debt ceiling by $5 trillion dollars while “massively” growing the deficit.

House Speaker Mike Johnson also spoke out against Musk, saying “I think Elon is flat wrong.”

Developing…

Judge Says Education Department Remains Barred From Canceling COVID-19 School Aid

Judge Says Education Department Remains Barred From Canceling COVID-19 School Aid

Authored by Aldgra Fredly via The Epoch Times,

A federal judge issued an order on June 3 preserving a previous preliminary injunction that had blocked the Department of Education from rescinding extensions given to states for accessing COVID-19-related funds for school districts.

District Judge Edgardo Ramos of the Southern District of New York said the injunction he issued on May 6 will remain in effect amid the ongoing litigation involving 16 states and the District of Columbia, which brought the case on April 10 alleging that the Education Department’s reversal in granting the extensions for accessing the Education Stabilization Fund (ESF) was arbitrary, in violation of the law.

ESF allocated more than $276 billion to support school districts in mitigating the effects of the COVID-19 pandemic.

States were initially given until Sept. 30, 2024, to obligate the use of funds, and until Jan. 28, 2025, to access the funds to liquidate the obligations.

The department later granted extensions to the plaintiffs, allowing them to access the funds through March 2026.

Education Secretary Linda McMahon subsequently informed the states in March this year that the previously granted extensions were being rescinded because the pandemic was over and extending the deadline was no longer aligned with the department’s current priorities, although the states could reapply for extensions.

In the June 3 ruling, Ramos ordered the department to process the plaintiffs’ outstanding and future requests for the funding “without delay” and provide a status report detailing the payment.

The department was also barred from enforcing a May 11 directive requiring the plaintiffs to liquidate their obligations under the ESF by May 24, according to the ruling.

The Department of Education did not return a request for comment by publication time.

Government lawyers argued in an April 24 brief that the department’s actions were not arbitrary and capricious “because rescission of the prior extension was within the Department’s discretion” and that they “did not conflict with the relevant appropriations statutes.”

The lawyers also stated that the plaintiffs would not suffer irreparable harm in the absence of an injunction because they still had the option to reapply for a fresh extension but had chosen not to do so.

Ramos issued the preliminary injunction on May 6, blocking the department from rescinding the previously approved extensions for accessing the funds. The judge also required department officials to give the plaintiffs at least 14 days’ notice before making any changes to the extensions.

The lawsuit was brought by the attorneys general of New York, Arizona, California, Delaware, Hawaii, Illinois, Maine, Maryland, Massachusetts, Michigan, Minnesota, New Jersey, New Mexico, Nevada, Oregon, and the District of Columbia, as well as Pennsylvania Gov. Josh Shapiro.

Supreme Court Unanimously Rejects Mexico’s $10 Billion Lawsuit Against U.S. Gunmakers

Supreme Court Unanimously Rejects Mexico’s $10 Billion Lawsuit Against U.S. Gunmakers

The U.S. Supreme Court unanimously tossed out Mexico’s 2021 lawsuit against seven U.S. gunmakers and one wholesaler, ruling that firms like Smith & Wesson and Glock are shielded from liability under the federal Protection of Lawful Commerce in Arms Act (PLCAA).

Mexico’s lawsuit accused U.S. gunmakers of knowingly enabling illegal firearm sales to dealers linked to drug cartels, fueling cartel violence. The government sought $10 billion in damages and a court order imposing stricter rules on the marketing and distribution of firearms.

Mexico attempted to use PLCAA’s narrow “predicate exception,” claiming the gunmakers knowingly violated federal firearms laws by aiding and abetting illegal sales by U.S. dealers.

Here’s the Supreme Court’s rationale that went into their unanimous decision:

  • The Court, led by Justice Elena Kagan, found that Mexico’s complaint did not plausibly allege that the manufacturers took deliberate, affirmative steps to facilitate crimes — a requirement for aiding and abetting liability.

  • Allegations that manufacturers failed to monitor dealers or cut off suspected “bad apple” dealers were deemed insufficient. Passive nonfeasance or general market activity does not amount to aiding and abetting.

  • Design and marketing choices (e.g., Spanish-language branding, military-style weapons) were not enough to imply culpability under U.S. law.

Justice Elena Kagan, writing for the majority, acknowledged rampant cartel violent crime, but found that Mexico failed to present allegations strong enough to overcome PLCAA’s liability shield, rejecting claims that the gunmakers aided and abetted illegal firearm sales.

“The question presented is whether Mexico’s complaint plausibly pleads that conduct. We conclude it does not,” Kagan wrote.

Meanwhile, Democrats in Congress have introduced legislation intended to reduce the flow of guns across the border. Yet Democrats facilitated four years of disastrous open borders under the Biden-Harris regime era…

Bongino: FBI Found Sensitive Docs Linked To James Comey; COVID Investigation Reopened

Bongino: FBI Found Sensitive Docs Linked To James Comey; COVID Investigation Reopened

Via VigilantFox.com

FBI Deputy Director Dan Bongino appeared on Hannity Wednesday night to outline the Bureau’s current priorities and address concerns around national security, immigration, and public health transparency.

The interview offered a detailed look into how the FBI, under the direction of Bongino and Director Kash Patel, is approaching both domestic and international threats during the early stages of a second Trump administration.

Hannity opened by asking about the FBI’s top priorities. Bongino responded by stating that their first objective is preventing large-scale terrorist attacks in major U.S. cities.

“We can’t have New York, D.C., or L.A. go boom,” he said.

He explained that this concern is not hypothetical—it shapes their daily operational briefings. Working closely with Patel, Bongino said their mission starts each morning with this scenario in mind.

But he emphasized that other serious threats are on equal footing. He pointed to cyberattacks that could disrupt infrastructure and foreign efforts to infiltrate U.S. intelligence operations.

“The massive cyber threat, the counterintelligence threat,” he said, are now “co-equal priorities.”

Hannity then brought up the southern border. Bongino acknowledged the scale of unlawful entry and said the concern extends beyond numbers to intent.

“There are people here… who want to do bad things—I think that is fairly obvious.”

He said FBI teams are deployed early in the morning to carry out removals and disrupt plots before they can be carried out.

“We have our FBI teams out there at 4:00 AM and 5:00 AM, removing these people from the country, while still preventing a terror attack.”

On the topic of how the Bureau classifies certain acts, Bongino said they are taking a more direct approach.

“We’re not the Federal Bureau of freaking word games anymore.”

He noted that acts involving targeted violence and extremist slogans will be treated as terrorism.

“We’re damn well going to investigate it—as targeted violence and a terror attack.”

He added, “What the hell do you want us to investigate it as? A freaking grand larceny auto?!”

The conversation then shifted to COVID-19. Hannity asked whether the government had misled the public about the virus’s origin.

“Covid origins, are we going to find out information that the government lied to us?”

Bongino answered, “You’re damn right you are. We’re all over that.”

When asked if the misinformation was deliberate, Bongino said an investigation is already underway.

“Well, you’re going to find out. Yeah, listen, that’s the one I am the most optimistic about.”

He shared that reopening the case was one of his first actions in the role.

“I was pretty clear on my social media account that I ordered that case immediately to be looked into again. We have a great investigator on it and I think we should see action on that one shortly.”

Hannity next asked whether former FBI officials would be held accountable. Bongino focused on former Director James Comey, who he said has publicly criticized current FBI leadership.

“Comey, as a matter of fact, the guy who has a lot to say, ironically, about me and Kash—and that’s fine, you know, he is allowed an opinion, he is a free American citizen like anybody else—but we found the items.”

Bongino said those items included sensitive documents.

“I addressed this on Fox & Friends and I can go into a little bit more detail, but we found the things,” Bongino reiterated.

“We found documents—documents that were not where they should have been. And they were not good flattering documents for Jim Comey.”

He framed it as part of a broader issue around internal culture.

“The hubris displayed from a man like Jim Comey, who disgraced the FBI numerous times with his role in Crossfire Hurricane and other abominations, it’s just kind of stunning that he continues to attack our leadership, when we have to clean up the mess that Jim Comey created… as we continue to find stuff from his era and vintage.”

Hannity closed by asking what the FBI might look like a year into a second Trump term. Bongino said the goal is a complete overhaul of operations.

“A year from now, I want the FBI to have played a key role in the deportation of hundreds of thousands of violent criminals from the United States.”

“I want the FBI to have thwarted multiple terror plots that we can’t tell you about every day.”

He said many of those outcomes will remain invisible to the public.

“Sean, every morning we do a briefing, Kash and I, with our ops directors. We can’t sit here and take a victory lap every time something does not go boom,” Bongino said.

“Matter of fact we almost never do it because we can’t.”

He outlined additional goals, including strengthening counterintelligence, addressing Chinese cyber espionage, and confronting the threat posed by drones.

“I want to make sure that our counterintelligence operation is top-notch… that the ever-present threat of the Chinese Communist Party infiltrating our systems, cyber spying on us—that by the end we have made significant progress,” he said.

“I want to be sure the drone threat—that we’ve taken action on it, not just talked about it.”

Finally, Bongino explained that the Bureau’s success should be reflected in measurable public safety outcomes.

“I want to make sure we can look back to the American people and say, look—with President Trump’s leadership, Attorney General Pam Bondi, and Director Patel—the murder rate is at a historic low.”

“Crime rates have gone down,” Bongino said, adding, “The border is sealed, and your FBI took a part in that.”

China Automakers Are Overtaking Japanese Competitors In Thailand

China Automakers Are Overtaking Japanese Competitors In Thailand

Japan’s hold on Thailand’s auto market is quickly slipping as Chinese brands make big gains. Japanese automakers’ market share fell to 65% in April—down over 10 points from a year earlier and far below the ~90% they once enjoyed, according to Toyota Motor Thailand data.

Meanwhile, six Chinese-owned brands doubled their share to a record 24%, led by BYD at 14%, according to Nikkei.

While Thailand’s auto market grew just 1% year-on-year to 47,193 vehicles—thanks to a boost from the Bangkok International Motor Show—sales are being held back by high household debt and tough auto loan approvals, keeping monthly sales at around 40,000 units. Even pickup truck sales, the “national car,” have slumped 21%.

Toyota’s April sales fell 8% but it still led with 38% share. Isuzu dropped 18% to 12% share, Honda’s sales plunged 42% to 7% share, and Mitsubishi’s sales fell 21% to 4%.

Nikkei writes that Chinese automakers saw huge growth: BYD sales jumped 7.3 times, giving it 14% share, passing Isuzu and Honda. MG’s share hit 5% with a 46% sales increase, while Changan hit 3% after a 53% rise.

Driving China’s surge: BYD’s aggressive discounting at the motor show, plus new plug-in hybrids and EVs. BYD’s sales now outpace Japanese brands in some segments.

Recall, we wrote last month how China part makers in Thailand had tripled.

And we said we couldn’t help but notice the timing – with tariffs on goods coming from China through the roof – seems to be…coincidentally beneficial for Chinese corporations.

In the Eastern Economic Corridor, about two hours from Bangkok, new factories are rapidly rising. Battery maker Sunwoda Electronic is investing over $1 billion to build a lithium-ion battery plant, with mass production set for 2025. Battery cells will be made locally, and a Thai official noted it’s likely to become Southeast Asia’s first plant producing batteries from cells.

More than 20 Chinese auto brands, including BYD and Great Wall Motor, have entered Thailand.

BYD’s factory, which began production in July 2024, is becoming the hub of a growing supply chain. Alongside Sunwoda, battery makers CALB, Gotion, and SVOLT have started local production, while CATL is building a joint venture plant with Thailand’s state-owned PTT.

However it may not all be tariff related. Nikkei writes that Chinese manufacturers began accelerating their investments in Thailand around 2018, amid rising U.S.-China trade tensions.

As of March, Chinese-invested auto parts companies in Thailand reached 165—over triple the number from the end of 2017. Across Southeast Asia, Chinese companies established more than 7,000 firms by 2023, with direct investment topping a record $25 billion that year.

This growth is expected to continue. In April, Ningbo Tuopu Group announced plans to invest up to $300 million in a Thai factory, saying the move would help it “win more orders and strengthen support for important foreign customers.”

Nikkei writes that Japanese automakers, dominant in Thailand since the 1960s, have built a network of about 1,400 local suppliers through joint ventures and vertically integrated operations. In contrast, Chinese carmakers are building independent supply chains, often excluding Japanese-linked suppliers.

Chinese parts are nearly 30% cheaper than those from Japanese firms, and Chinese companies typically produce core components like batteries in-house or source them from affiliated suppliers. “Thai suppliers will not be able to fully benefit from the Chinese push into the country,” Sompol said.

Biden’s Border Nihilism Will Live Long After He Is Gone

Biden’s Border Nihilism Will Live Long After He Is Gone

Authored by Victor Davis Hanson via American Greatness,

The spiteful open-borders legacy of Joe Biden will plague America for generations to come, long after the former president is a fading bad memory.

Somewhere between 10-12 million foreign nationals are believed to have entered the U.S. illegally under his watch, to add to the existing 12-20 million illegal aliens.

Almost all were unaudited.

They stormed the border for four years without background checks of the sort that American citizens must undergo to purchase a firearm or take out a loan.

At a time when citizens were expelled from the military for not submitting to the experimental mRNA COVID inoculations, millions of foreign nationals, with the Biden administration’s encouragement, crossed the southern border, exempt from any vaccination requirement or medical examination.

When Americans were required to present multiple forms of identification to apply for a mandatory “real ID” to fly in 2025, millions of illegal entrants were flown across the country, often stealthily and under the cover of night, without any valid ID at all.

On some days, the Trump administration has managed to deport 800 of Biden’s illegal aliens.

But ten times that many entered illegally each day under Biden.

Trump’s border patrol would have to deport over 8,000 people every day of his four-year tenure just to undo what Biden wrought by his dismantling of federal immigration law.

Some 500,000 illegal entrants are believed to have criminal records—a number greater than the population of Oakland, California.

Indeed, new reports relate almost every day that another illegal alien has murdered, raped, or assaulted an American citizen.

The culpable left often champions violent illegal alien criminals facing deportation. Their apparent assumption is that hurting Trump politically justifies hurting Americans even more by protecting violent illegal alien criminals instead of sending them home.

Thousands of these unknown criminals are deadly land mines waiting to explode.

Yet the Biden effort to destroy or subvert immigration law transcends just demolishing the southern border.

There are nearly 300,000 Chinese nationals in American universities, the vast majority admitted without serious background checks.

They are welcomed by elite campuses because they pay the full cost and at a premium, with few questions asked about why exactly they came or what they are doing.

No wonder, then, that in the last decade, Harvard’s Kennedy School of Government is reported to have trained and graduated hundreds of Chinese nationals who were either Communist Party members or the children of prominent Chinese communist apparatchiks.

In other words, at a time when the U.S. is locked in an escalating Cold War with the People’s Republic of China, our universities find great profit in enrolling and educating the communist elite who threaten Taiwan, imprison and oppress the Uyghurs, jail Hong Kong dissidents, and send both bio- and agro-terrorists into the U.S.

Not a day went by during the last two years without Middle Eastern, pro-Hamas visa students on some campus swarming students in libraries, assaulting and bullying Jews, trashing iconic buildings, illegally camping out in student quads, and screaming to bring the intifada home to the U.S.

Neither the Biden administration nor spineless college presidents took any action, despite such flagrant violations of both the terms and spirit of student visas.

Most recently, Yunqing Jian, a 33-year-old Chinese national with ties to the University of Michigan, was arrested as an “agro-terrorist.”

The mission of Jian, along with his girlfriend, was to seed toxic fungus into midwestern farmland as a way of destroying the American food supply and thereby starve his hosts.

Sometimes the baleful Biden immigration inheritance was simply a matter of allowing “tourists” and “visitors” to stay far after their visas had expired—without consequences.

So, for example, Egyptian national and terrorist, Mohamed Soliman, along with his entire family, deliberately overstayed their visas. They were all residing here illegally when Mohamed firebombed Jews, crying out “Free Palestine” as he tried to burn them up.

Americans overwhelmingly polled against this Biden border nihilism. Indeed, the House impeached his henchman, Alejandro Mayorkas, the Secretary of Homeland Security.

Yet Biden, or his handlers in the shadows, would not stop destroying the borders and immigration law.

So why would a president deliberately cause such mayhem that will cost hundreds of lives and billions of dollars in the years to come?

Was the reason Biden’s characteristic incompetence or dementia?

Or did Biden simply want to alter the demography to find a constituency for his otherwise unpopular agendas?

Did he wish to grow the welfare state?

Was Biden hoping to expand the DEI agenda by bringing in the poor and supposedly oppressed as new fodder in the Left’s Marxist binary of victimized versus victimizer?

No one knows why Biden did it, only that he did—and we will suffer his nihilist legacy for years to come.

*  *  *

Lululemon Craters 20% After Slashing Guidance

Lululemon Craters 20% After Slashing Guidance

Lululemon shares cratered after the ridiculously overpriced maker of butt pushup tights cut its profit outlook for the full year and projected lower-than-expected sales for the current quarter.

The company now projects sales in the range of $2.54 billion to $2.56 billion for its fiscal second quarter, lower than the average analyst estimate. For the full year, Lululemon reduced its earnings per share outlook by about 2.5%.

Here is what LULU reported for Q1:

  • EPS $2.60, in line with estimate $2.60
  • Net revenue $2.37 billion, beating estimate $2.36 billion
    • China Mainland net revenue $368.1 million, missing estimate $378.7 million
    • Rest of World net revenue $328 million, missing estimate $328.7 million
  • Total comp sales constant currency +1%, estimate +2.76%
    • Americas comp sales in constant currency -1%, estimate -1.34%
    • International Comp Sales Ex-Fx +7%
  • Gross margin 58.3%, beating estimate of 57.7%
  • Operating margin 18.5%, beating estimates of 18.4%
  • Inventory $1.65 billion, higher than estimates of $1.55 billion
  • Total location count 770, estimate 770.05

While the Q1 results were generally ok, comparable-store sales were disappointing growing only 1%, and short of the estimate of 2.8%. The Americas business posted negative comparable-store sales in the period.

But it got much worse when the company revealed its latest forecast:

Q2 forecast:

  • Net revenue $2.54 billion to $2.56 billion, missing estimates of $2.57 billion (Bloomberg Consensus)
  • Sees EPS $2.85 to $2.90, badly missing estimate $3.31

2026 Full year forecast

  • Sees EPS $14.58 to $14.78, slashing the previous range of $14.95 to $15.15, and missing estimate $14.91
  • Still sees net revenue $11.15 billion to $11.3 billion, below the estimate $11.29 billion

Or putting it sideways:

The market was not expecting this from the former growth darling and Lululemon shares fell over 20% at 4:45 pm in afterhours trading. The stock has declined nearly 14% so far this year through Thursday’s close.

While CEO Calvin McDonald was looking to double Lululemon’s sales from their 2021 level and hit $12.5 billion by 2026, growth has slowed as the retailer struggles to cope with cautious shoppers, higher inflation and growing competition.

Management has tried to lift demand by entering new product categories and expanding its offerings to sports such as running, tennis and golf. Lululemon is also dealing with shifts in fashion trends, with more consumers – supposedly those who ran out of money for ozempic – opting for baggier styles instead of the form-fitting yoga pants for which the brand is best known.

So far, all those efforts have clearly failed and the stock reflects it in after hours trading where it has lost almost 25% of its value.

Risk of Escalation With Russia ‘Going Way Up’ Due To Ukrainian Attacks: Kellogg

Risk of Escalation With Russia ‘Going Way Up’ Due To Ukrainian Attacks: Kellogg

Authored by Kyle Anzalone via The Libertarian Institute,

President Donald Trump’s special envoy to the Ukraine conflict said that recent Ukrainian attacks on Russian air bases have created a significant risk of escalation in the war.

“I’m telling you, the risk levels are going way up – I mean, what happened this weekend,” Trump’s envoy, Keith Kellogg, told Fox News.

“People have to understand in the national security space: when you attack an opponent’s part of their national survival system, which is their triad, the nuclear triad, that means your risk level goes up because you don’t know what the other side is going to do. You’re not sure,” Kellog explained.

On Sunday, the Ukrainian intelligence service, the SBU, launched a major attack on Russian airbases thousands of miles from the front lines. Kiev claims to have disabled one third of Moscow’s fleet of strategic bombers.

Washington and Moscow each possess the ability to conduct nuclear attacks via bombers, submarines, and land-based ballistic missiles, known as the nuclear triad.

The White House claims that it was not informed of the attack by Kiev. However, the CIA is deeply tied to the SBU.

The SBU has conducted other provocative attacks in recent days, hitting Russian railways and bridges and reportedly killing seven civilians.

Trump said he spoke with Russian President Vladimir Putin about the attacks on Wednesday.

“I just finished speaking, by telephone, with President Vladimir Putin, of Russia. The call lasted approximately one hour and 15 minutes,” Trump wrote on Truth Social.

The below is a reaction from independent journalist and geopolitical commentator Michael Tracey:

– If no one in the US military/intel apparatus knew about the sweeping Ukrainian drone attack on Russia’s nuclear triad that was supposedly being planned for 1.5 years, they’re catastrophically incompetent

– If elements of that apparatus did know and purposely kept it from Trump, then Trump is suffering from the same problems we were told dogged him in the first term, and were going to be solved in the second term

– That is, Trump is being subtly subverted by underlings with conflicting agendas

– As a compounding factor, it could be the case that Trump still lacks the attention, interest, and/or organizational capacity to ensure his chain-of-command funnels such information to the top

– It could alternatively be the case that high-level administration officials, up to and including Trump, did in fact know about the attack in advance. After all, it was only last week that Trump warned on Truth Social that “really bad things” may be in store for Russia…

– In that scenario, Trump and administration officials simply wish to retain plausible deniability for political/diplomatic reasons

– Without dispositive evidence for any of the possible scenarios, the scenario one thinks to be the most likely will inevitably align with their preconceived notions about Trump, Ukraine, and Russia

“We discussed the attack on Russia’s docked airplanes, by Ukraine, and also various other attacks that have been taking place by both sides,” Trump stated. “It was a good conversation, but not a conversation that will lead to immediate Peace. President Putin did say, and very strongly, that he will have to respond to the recent attack on the airfields.”
